{"id":32803,"date":"2018-07-27T13:51:53","date_gmt":"2018-07-27T18:51:53","guid":{"rendered":"http:\/\/innovatori.space\/lat21\/?p=32803"},"modified":"2018-07-27T17:02:29","modified_gmt":"2018-07-27T22:02:29","slug":"las-plataformas-de-rentas-vacacionales-y-el-condominio-unifamiliar","status":"publish","type":"post","link":"https:\/\/l21.mx\/?p=32803","title":{"rendered":"Las plataformas de rentas vacacionales y el condominio unifamiliar."},"content":{"rendered":"<p><img fetchpriority=\"high\" decoding=\"async\" class=\"aligncenter size-large wp-image-32805\" src=\"http:\/\/l21.mx\/wp-content\/uploads\/2018\/07\/Latitud-21-Art\u00edculo-B2-1-1024x88.png\" alt=\"\" width=\"1024\" height=\"88\" srcset=\"https:\/\/l21.mx\/wp-content\/uploads\/2018\/07\/Latitud-21-Art\u00edculo-B2-1-1024x88.png 1024w, https:\/\/l21.mx\/wp-content\/uploads\/2018\/07\/Latitud-21-Art\u00edculo-B2-1-300x26.png 300w, https:\/\/l21.mx\/wp-content\/uploads\/2018\/07\/Latitud-21-Art\u00edculo-B2-1-768x66.png 768w, https:\/\/l21.mx\/wp-content\/uploads\/2018\/07\/Latitud-21-Art\u00edculo-B2-1-1536x132.png 1536w, https:\/\/l21.mx\/wp-content\/uploads\/2018\/07\/Latitud-21-Art\u00edculo-B2-1-2048x176.png 2048w, https:\/\/l21.mx\/wp-content\/uploads\/2018\/07\/Latitud-21-Art\u00edculo-B2-1-1920x165.png 1920w, https:\/\/l21.mx\/wp-content\/uploads\/2018\/07\/Latitud-21-Art\u00edculo-B2-1-1170x100.png 1170w, https:\/\/l21.mx\/wp-content\/uploads\/2018\/07\/Latitud-21-Art\u00edculo-B2-1-585x50.png 585w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/>Las plataformas digitales han incrementado exponencialmente las llamadas rentas vacacionales, es decir, propiedades individuales que no forman parte de un hotel pero que son utilizadas para atraer turistas a esas propiedades, lo que ha generado muchas inconformidades, todas ellas muy v\u00e1lidas por que se sustentan en la omisi\u00f3n en el pago de impuestos, la falta de licencias y permisos, y, en el caso de condominios residenciales unifamiliares, la violaci\u00f3n a los estatutos del condominio.<\/p>\n<p>Como es sabido, un condominio puede tener como fin o destino el uso comercial (un centro comercial, por ejemplo) o tur\u00edstico (un <em><strong>condohotel<\/strong><\/em>) o residencial unifamiliar o un destino mixto.<\/p>\n<p>Para los efectos de este ejercicio me quiero referir a los condominios destinados a fines unifamiliares residenciales, es decir, en donde s\u00f3lo vive una familia por casa departamento o casa dentro de un condominio. El articulo 2023 del c\u00f3digo civil de Quintana Roo establec\u00eda una prohibici\u00f3n expresa para que un condominio en un r\u00e9gimen de esta clase pudiera rentar una parte de una unidad condominal como por ejemplo una recamara o un cuarto de servicio, sin embargo, el problema empez\u00f3 a crecer con la nueva ley de propiedad en condominio de inmuebles de Quintana Roo de 2011 que no solamente derogo el referido articulo 2023 sino que todo el articulado relativo al r\u00e9gimen de propiedad en condominio contenido en el c\u00f3digo civil estatal, ya que esta nueva ley omiti\u00f3 la prohibici\u00f3n antes mencionada.<\/p>\n<p>De acuerdo con el articulo segundo transitorio del decreto que promulga esta nueva ley condominal, los reg\u00edmenes constituidos antes de la entrada en vigor de la nueva ley continuar\u00e1n rigi\u00e9ndose conforme a su escritura constitutiva y su reglamento a partir de que se reformen cualquiera de estos ordenamientos, se aplicar\u00e1 la nueva ley si esa escritura constitutiva o ese reglamento contiene la prohibici\u00f3n arriba mencionada, no hay lugar a dudas que sigue vigente, pero si no existe esa prohibici\u00f3n en los estatutos del condominio los usuarios se escudan en un principio que se\u00f1ala que lo que no esta prohibido esta permitido y nada m\u00e1s falso que esto.<\/p>\n<p>Las reglas fundamentales en los reg\u00edmenes condominales unifamiliares es que, independientemente de que exista o no esa prohibici\u00f3n en la nueva ley o en los estatutos del condominio, y sin importar si se trata de una recamara o de toda la unidad condominal , un condominio residencial es para uso de una familia y no para recibir turistas, por que esto viola el destino del condominio.<\/p>\n<p>Lo que tiene que venir ahora es no solo una adecuada reglamentaci\u00f3n mediante las conducentes adiciones a la ley condominal vigente por parte del congreso del estado de Quintana Roo, si no adem\u00e1s que cada r\u00e9gimen de esa propiedad unifamiliar adopte las medidas y restricciones pertinentes mediante acuerdos tomados en asamblea de condominios, ya sea para permitir las rentas vacacionales o prohibirlas y establecer las sanciones
