En un comunicado, la dependencia federal se\u00f1al\u00f3 que la plataforma Airbnb viola lo establecido en la Ley Federal de Protecci\u00f3n al Consumidor<\/strong><\/h1>\n

La Procuradur\u00eda Federal del Consumidor (Profeco) inici\u00f3 procedimientos contra las plataformas de hospedaje\u00a0Airbnb y Booking<\/em>\u00a0por publicidad enga\u00f1osa y cl\u00e1usulas abusivas, respectivamente.<\/h1>\n<\/div>\n<\/div>\n

En un comunicado, la dependencia federal se\u00f1al\u00f3 que la plataforma Airbnb viola lo establecido en la Ley Federal de Protecci\u00f3n al Consumidor <\/strong>pues \u2018miente\u2019 en su publicidad al se\u00f1alar que tiene las comisiones ‘m\u00e1s bajas del mercado’ (3-5 por ciento).<\/p>\n

As\u00ed tambi\u00e9n, la Procuradur\u00eda se\u00f1al\u00f3 que en los t\u00e9rminos y condiciones de contrataci\u00f3n, Airbnb establece una comisi\u00f3n de entre el 3 y el 20 por ciento<\/strong> por el servicio de intermediaci\u00f3n.<\/p>\n

En cuanto a\u00a0Booking<\/em>,\u00a0la dependencia indic\u00f3 que esta plataforma de comercio electr\u00f3nico tiene\u00a0cl\u00e1usulas \u2018abusivas\u2019<\/strong>, a trav\u00e9s de las cuales se deslinda de cualquier responsabilidad legal. Encontr\u00f3 que dicha compa\u00f1\u00eda tiene prestaciones \u2018desproporcionadas\u2019 tales como la renuncia a la jurisdicci\u00f3n de los tribunales mexicanos.<\/p>\n

Por lo que la procuradur\u00eda se\u00f1al\u00f3 que ambas plataformas no cuentan con un domicilio en el pa\u00eds para que los clientes establezcan\u00a0quejas.<\/strong><\/p>\n

Respecto a estos se\u00f1alamientos,\u00a0Roc\u00edo Paniagua, directora de Asuntos P\u00fablicos de Airbnb en M\u00e9xico, indic\u00f3 que Airbnb analiza cada uno de los presuntas violaciones presentadas por la Profeco.<\/p>\n

\u00abEstamos en toda la disposici\u00f3n de trabajar con la Profeco para resolver cualquier duda y ver qu\u00e9 podemos hacer para atender a nuestra comunidad en M\u00e9xico\u00bb, dijo en entrevista telef\u00f3nica Roc\u00edo Paniagua, directora de Asuntos P\u00fablicos de Airbnb en M\u00e9xico.<\/p>\n

Puntualiz\u00f3 que el 97 por ciento del total de la tarifa va a los anfitriones, mismos que fijan el precio de los alojamientos y que estos\u00a0cuenta con un seguro por da\u00f1os de hasta un mill\u00f3n de d\u00f3lares en las propiedades que se ofertan en su sitio y aplicaci\u00f3n.<\/p>\n

Airbnb aclar\u00f3 que si bien no es propiamente un prestador de servicios de alojamiento, sus usuarios cuentan con el respaldo de la empresa ante una eventual ‘mala experiencia’.<\/p>\n

\u00abNosotros nunca hemos dicho que somos prestadores de servicios de alojamiento, quienes lo hacen son los anfitriones.
