{"id":37445,"date":"2019-04-30T13:32:32","date_gmt":"2019-04-30T18:32:32","guid":{"rendered":"https:\/\/l21.mx\/?p=37445"},"modified":"2019-04-30T13:32:57","modified_gmt":"2019-04-30T18:32:57","slug":"aprueba-senado-reforma-laboral","status":"publish","type":"post","link":"https:\/\/l21.mx\/?p=37445","title":{"rendered":"Aprueba Senado reforma laboral"},"content":{"rendered":"\n<p>Con 120 votos a favor,\ncero en contra y dos abstenciones, el <strong>Pleno\ndel Senado<\/strong>&nbsp;aprob\u00f3 en lo\ngeneral la&nbsp;<strong>Reforma Laboral<\/strong>&nbsp;para\ntener un ordenamiento en la materia acorde con el Tratado de Libre Comercio\nentre M\u00e9xico, Estados Unidos, Canad\u00e1 (T-MEC), promover la democracia sindical y\ncrear los juzgados laborales.<\/p>\n\n\n\n<p>De esta forma, los senadores aprobaron el\ndictamen de la minuta recibida de San L\u00e1zaro, seg\u00fan el cual se crean las bases\npara un nuevo sistema de justicia laboral y fija reglas para que los sindicatos\nelijan libremente a sus l\u00edderes.<\/p>\n\n\n\n<p>Se plante\u00f3 que las cuotas\na los sindicatos deben ser voluntarias y no obligatorias y que los patrones no\npueden descontar directamente de la n\u00f3mina las aportaciones de los trabajadores\na los sindicatos. De la misma forma se frena el&nbsp;<strong>Outsourcing<\/strong>.<\/p>\n\n\n\n<p>Asimismo, de acuerdo con la normatividad\naprobada, los tribunales laborales depender\u00e1n del Poder Judicial, por lo que\ndesaparecen las juntas federales y locales de Conciliaci\u00f3n y Arbitraje, \u00f3rganos\ntripartitas, entre la<strong>&nbsp;Secretar\u00eda del Trabajo<\/strong>,\nla patronal y los&nbsp;<strong>sindicatos<\/strong>, que\ndirim\u00edan huelgas y controversias laborales.<\/p>\n\n\n\n<p>Por lo tanto, se crea ahora el Centro\nFederal de Conciliaci\u00f3n y Registro Laboral, que sustituye a las juntas de\nconciliaci\u00f3n para pasar a un nuevo sistema de justicia laboral en el que las\ndemandas ser\u00e1n tratadas en tribunales del Poder Judicial y todos los contratos\ncolectivos ser\u00e1n depositados en ese organismo.<\/p>\n\n\n\n<p>De igual forma, la&nbsp;<strong>Ley Federal del Trabajo<\/strong>&nbsp;se\narmoniza con el Cap\u00edtulo Laboral del&nbsp;<strong>T-MEC,&nbsp;<\/strong>y\nse ratifica el Convenio 98 de la Organizaci\u00f3n Internacional del Trabajo (<strong>OIT),<\/strong>&nbsp;que\nestablece libertad de asociaci\u00f3n sindical y los contratos colectivos.<\/p>\n\n\n\n<p>Por otra parte,<strong>&nbsp;se elimina el voto a mano\nalzada para elecci\u00f3n de l\u00edderes sindicales,<\/strong>&nbsp;pues estos\nser\u00e1n sujetos al voto personal, libre, directo y secreto, y se instauran\nmecanismos para garantizar que los trabajadores sean realmente representados\npor los sindicatos, lo que frenar\u00eda los sindicatos \u00bb blancos\u00bb o de\nprotecci\u00f3n patronal.<\/p>\n\n\n\n<p>Tambi\u00e9n se incluyen garant\u00edas al trabajador\ndesde lo individual para hacer valer sus derechos laborales y de esta manera\nnadie puede ser sujeto a represalias ni ser obligado a formar parte de un\nsindicato, federaci\u00f3n o confederaci\u00f3n.<\/p>\n\n\n\n<p>Asimismo, se crean salarios profesionales\npara los trabajadores del campo y para las<strong>&nbsp;trabajadoras dom\u00e9sticas.<\/strong><\/p>\n\n\n\n<p>Con esto se reformar\u00e1n\ncinco leyes: Federal del Trabajo, Org\u00e1nica del Poder Judicial de la Federaci\u00f3n,\nFederal de la Defensor\u00eda P\u00fablica, del Instituto del Fondo Nacional de la\nVivienda para los Trabajadores y del Seguro
