Gonz\u00e1lez Campos\u00a0<\/strong><\/p>\n<p><strong>recepci\u00f3n@notaria7cancun.com\u00a0<\/strong><\/p>\n<p><strong>CUARTO DE HU\u00e9SPEDES<\/strong><\/p>\n<p>Cuando se habla del testamento lo primero que a la gente le viene a la mente es la cl\u00e1sica escena de cuando se muere el pariente rico y llega el momento esperado por todos de abrir el testamento y ver qu\u00e9 le dejaron a cada quien.<\/p>\n<p>Se trata de algo mucho m\u00e1s all\u00e1 de una escena tr\u00e1gica, es un procedimiento legal en la planeaci\u00f3n estrat\u00e9gica patrimonial.<\/p>\n<p>Cuando ocurre el fallecimiento de una persona que tiene bienes y no hizo testamento llegan tambi\u00e9n los problemas que genera el intestado, y se convierte en toda una cuesti\u00f3n legal y fiscal.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00bfCu\u00e1les son los beneficios<\/p>\n<p>de hacer tu testamento?<\/p>\n<p>&nbsp;<\/p>\n<p>1. Garantizar que los derechos sobre tus bienes se puedan transmitir en forma ordenada y pac\u00edfica a quien t\u00fa lo decidas.<\/p>\n<p>2. Proteger el patrimonio de la familia y asegurar que tus bienes permanezcan en el seno familiar.<\/p>\n<p>3. Definir qui\u00e9n heredar\u00e1 tus bienes, lo que evitar\u00e1 posibles conflictos, gastos innecesarios, p\u00e9rdida de tiempo y, en muchos casos, pleitos que alteren la tranquilidad familiar.<\/p>\n<p>4. Puedes se\u00f1alar e instruir, si lo deseas, al tutor que se har\u00e1 cargo de tus hijos menores de edad, o designar un albacea (representante legal) que administre los recursos econ\u00f3micos de ellos hasta su mayor\u00eda de edad, bajo ciertos par\u00e1metros y condiciones previamente establecidas.<\/p>\n<p>5. El otorgamiento del testamento es ante notario p\u00fablico, quien da fe de la voluntad del testador.<\/p>\n<p>&nbsp;<\/p>\n<p>\u00bfA qui\u00e9n elegir?<\/p>\n<p>&nbsp;<\/p>\n<p>Es dif\u00edcil elegir a qui\u00e9n heredar tu patrimonio, pero al hacerlo evitar\u00e1s posibles conflictos a tus familiares y seres queridos, adem\u00e1s es posible modificar tu testamento cuando lo desees si cambias de opini\u00f3n o si quieres agregar alg\u00fan nuevo beneficiario.<\/p>\n<p>Es muy f\u00e1cil hacer tu testamento y el costo puede ser significativo en comparaci\u00f3n con la tranquilidad y problemas que puedes evitar a tus familiares al momento de tu fallecimiento.<\/p>\n<p>Una vez que hayas elegido al notario ante quien deseas otorgarlo deber\u00e1s llenar un formato en el que pondr\u00e1s tus datos y los de tus herederos, si los herederos son menores de edad deber\u00e1s nombrar a un albacea y a un tutor; siendo el albacea el responsable de cumplir tu \u00faltima voluntad, ser\u00e1 quien cuide de los bienes y les d\u00e9 el destino que hayas decidido.<\/p>\n<p>Un tutor es la persona designada en un testamento cuando se tienen hijos menores de edad, ya que se encargar\u00e1 de representarlos, vigilarlos y hacerse cargo de su educaci\u00f3n. Es importante mencionar que en ning\u00fan caso el tutor puede disponer de los bienes que se les haya legado a los menores, a menos que tenga autorizaci\u00f3n expresa para ello.<\/p>\n<p>Los testamentos se pueden actualizar y modificar seg\u00fan la voluntad del testador o conforme vayan ocurriendo cambios, es decir, si cambia tu estado civil o hay cambios familiares, tambi\u00e9n si aumentas tu patrimonio o haces movimientos patrimoniales, y aun cuando hagas tu testamento puedes disponer de tus propiedades y bienes como consideres.<\/p>\n<p>En resumen, el testamento es un paso m\u00e1s en la planeaci\u00f3n estrat\u00e9gica patrimonial que debes hacer para tus inversiones, despu\u00e9s de todo vivimos para estar felices, tranquilos, y un testamento es tu legado de orden para los tuyos, para los que adquieres patrimonio.<\/p>\n<p>&nbsp;<\/p>\n<p>Notar\u00eda 7.
